Adamawa PDP crisis takes a bad turn as Ardo institutes court case against A.T Shehu led Exco

It is another bad turn on the Crisis rocking the political boat of People’s Democracy Democracy (PDP) in Adamawa state since the emergence of Reformed people’s Democracy Party(RPDP) led faction under the leadership of Dr Umar Ardo.

Dr Umar instituted a court case against the state chairman of the party Barr. A.T Shehu and 11 others over alleged flawed congress that brought them to office,stating that they are existing and operating on illegallity as it’s enshrined in the party’s constitution.

Ardo has approached a federal high court, Yola, praying for the dissolution of A.T Shehu led exco, saying that the congress that brought them to office was flawed and illegal.

The court has fixed November 26, 2020 for commencement of hearing.

In a notice of hearing addressed to Ardo and 2 others as plaintiffs/applicants versus People’s Democratic Party, it’s chairman, Barristar A.T Shehu and 10 others as defandants/respondants, the court directed the parties or their legal representation to appear before it by 9:00am, on Thursday November 26, 2020.

It further directed parties in the suit No. FHY/YL/CS/11/2020 to provide all necessary documents, evidences and witnesses relevant to the matter in written to the registrar of the court.

Applicants in the case including Umar Ardo, Ethan Buji and Hon. Ibrahim Ahidjo Karlahi approached the court challenging the party (PDP), state chairman, Barristar Shehu, Independent National Electoral Commission, (INEC) and 10 others for breach of constitution of the party and abuse of office.

They claimed that allowing the Barr. Shehu’s led executives of the party in the state after serving as caretaker committee that conducted congresses which they partook as contestants is strange to the law and also violates PDP constitution praying for the outright dissolution of the exco.

“All members of the party exco were members of the transitional committee established to conduct elections (congresses) into various offices of the party. They later turned to be contestants without resigning their positions as caretaker committee members.

“The act is a violation of the provisions of the People’s Democratic Party which also contravenes principles of equity and fairness and therefore renders the procedure repugnant to natural justice and so void.

“Section 48 of the PDP’s constitution prohibits holding dual offices or positions as done by Barristar Shehu and his Exco even Articles 15 (2) and 16 (2) of same constitution negates such actions”. Ardo said.

Ardo and co also prayed the court to dissolve all the 226 wards and 21 local government area executives of the party and urging the court to direct the Independent National Electoral commission to conduct new congresses to ensure compliance with the party’s constitution and the law.

The current political imbroglio rocking Adamawa State chapter of the party started in August 2017 when the tenure of the former executives under Chief Joel Hammajoda Madaki’s leadership expired and Barrister Shehu and his exco were appointed to hold sway in acting capacity but they took part in the congresses and become its substantive officials.
